Julia Bobrova has extensive experience in handling complex civil, corporate and bankruptcy litigations, in addition to administrative and IP disputes. Her experience involves acting on behalf of clients before Russian commercial courts and courts of general jurisdiction, including the Russian Supreme Court, the Russian Supreme Arbitrazh Court, the ICAC at the Russian Chamber of Industry and Trade, and international arbitration courts.
Julia specialises in comprehensive litigations involving corporate and bankruptcy law matters. She has significant experience in advising on the development of strategies and tactics for conducting bankruptcy proceedings, both on the side of creditors and debtors.
Julia’s recent career highlights include:
- Defending the interests of clients in cases involving subsidiary liability of general directors, beneficiaries and board members in bankruptcy cases.
- Representing an international trading company in isolated dispute over the invalidation of transactions on bankruptcy grounds, resulting in the retention of a valid chain of transactions for the acquisition of a poultry company during its reorganisation.
- Representing a major agro-industrial holding company before the Judicial Panel for Economic Disputes of the Russian Supreme Court in a dispute over the invalidation of a bankruptcy auction in which the client purchased assets worth over RUB 3bn.
- Defending the client in a dispute over recovery of expenses and lost profits in the amount of RUB 416.5m in connection with failure to perform the terms of a freight forwarding contract.
- Advising and supporting the client's participation in a tender for acquisition of an agricultural enterprise of a bankrupt company, which ruled in the client's favour. The project included support for signing an agreement and transfer of the property to the client.
- Defending the former CEO in a dispute over the recovery of RUB 1.1bn in damages. The claim was based on seven separate episodes, including unjustified bonus payments to the director himself and his team, loss of the company's property, failure to perform obligations to the company's counterparties, and fines and charges levied on the company. As the result of a successful defence, the claims against the director were dismissed in full.
- Representing an IT client before the court of cassation in a dispute over overstatement of costs in implementing a state contract and recovery of several hundred million roubles, which were deemed "overpaid" following an audit.
- Representing a major agro-industrial group in a court dispute related to the bankruptcy of its counterparty. The Firm's attorneys secured a full dismissal of the bankruptcy receiver's claims to invalidate payments made to the client as part of the bankruptcy of the counterparty.
- Defending former shareholders of a major bank in disputes with the bank's temporary administration in cases involving invalidation of transactions due to their conclusion on terms known to be unfavourable to the bank. Most of the agreements were recognised as valid.
- Representing a chemical plant in a complex series of related disputes against two general contractors. Successfully prevented a controlled bankruptcy of the contractors and recovery of substantial sums of money from the principal. The Judicial Panel for Economic Disputes of the Supreme Court upheld a number of the Firm's positions in disputing unlawful resolutions of creditors' meetings and, based on these positions, developed approaches for resolving similar disputes in the future.
- Advising on the risks of bringing the client and its beneficiaries to subsidiary liability for the debts of a business partner in connection with possible bankruptcy of a major private bank and holding company, as well as developing and implementing a strategy to minimise these risks.
- Defending a German shipyard before the International Commercial Arbitration Court at the Chamber of Commerce and Industry in a dispute with a client over performance of an icebreaker superstructure construction contract. The Firm's team carefully collected evidence, including conclusions on the economics of shipbuilding and calculations of losses incurred, and devised an effective procedural strategy. As a result, the firm was able to prevent the recovery of over RUB 220m from the client.
- Representing Alvarez & Marsal, a major international company specialising in crisis management and asset tracing, appointed by an English court as asset manager of the Kazakh BTA Bank. As a result of successful defence in more than 30 litigation cases, the Firm won a multi-stage corporate conflict and the client regained full corporate control over the White Sea Group companies (Belomorskaya Oil Terminal and Vitino Sea Port) and subsidiaries owned by BTA Bank.
Julia graduated from the Lomonosov Moscow State University Faculty of Law, and in addition to practicing law, she lectures at the National Research University Higher School of Economics and Statute Law School. Julia regularly speaks at business conferences on corporate law and bankruptcy matters, and she has authored numerous pieces in professional legal journals.
Julia is admitted to the Moscow Bar Association.
